Terms of Service

§1. General provisions

  1. These Terms of Service ("Terms") set out the rules for using the promptgenerator.pl website ("Service"), available at https://promptgenerator.pl.
  2. The owner and operator of the Service is Surfidea Jakub Włodarczyk, registered at ul. Zdziechowskiego 10/73, 02-659 Warsaw, Poland, NIP (Polish tax ID): 5342269498, REGON: 146003726, email address: kontakt@promptgenerator.pl ("Service Provider").
  3. Using the Service constitutes acceptance of these Terms.
  4. The User agrees not to submit unlawful content, including content that infringes the rights of third parties, or offensive content that incites hatred or violence.

§2. Definitions

  • Service - the promptgenerator.pl website, including all of its subpages and features.
  • User - any individual who has reached the age of 18 (including a Consumer), or any business entity using the Service.
  • Consumer - an individual entering into a legal transaction with the Service Provider that is not directly related to their business or professional activity (Art. 22(1) of the Polish Civil Code).
  • Sole trader with consumer rights - an individual running a sole proprietorship who enters into an agreement directly related to their business activity, where the content of that agreement shows it is not of a professional nature to them (Art. 385(5) of the Polish Civil Code and Art. 38a of the Polish Consumer Rights Act). Consumer-protection provisions in these Terms apply accordingly to such a person.
  • Account - an individual User account created upon registration with the Service.
  • Prompt - a text instruction created using the tools available in the Service, intended for use with AI models.
  • AI Image Studio - a feature of the Service that allows generating images using artificial intelligence models.
  • Point - the billing unit used in the Service. Generating, running, or improving a prompt costs 1 Point, and generating one image in the AI Image Studio costs 5 Points. Points do not expire. Every newly registered User receives a one-time free grant of 10 starting Points. (Points replaced the earlier image Credits; balances were converted without loss of value: 1 Credit = 5 Points.)
  • Points Package - a one-time purchase of a given number of Points, on the terms described in §4.
  • Digital Product - digital content as defined under the Polish Consumer Rights Act, sold as a one-time purchase in the Service (e.g. an e-book or a prompt pack in PDF format), delivered without a physical carrier on the terms described in §4a.
  • Electronic Services - electronic services provided by the Service Provider through the Service, covering both free and paid services.

§3. Types and scope of services

3.1. Free services

The Service provides the following features free of charge:

  • Generating, editing, and optimizing prompts for various AI models (ChatGPT, Claude, Gemini, and others).
  • Using the free AI tools available in the Service.
  • Saving and managing a prompt library (after registration).
  • Access to educational materials about prompt engineering.
  • A one-time grant of 10 free starting Points upon Account registration, to be used on the actions described in §4.

3.2. Paid services

Paid services include: (a) purchasing Points Packages. Points pay for: generating, running, and improving prompts (1 Point per action) and generating images in the AI Image Studio (5 Points per image); see §4 for details; (b) a one-time purchase of Digital Products (e.g. e-books); see §4a for details.

§4. Points and payments

4.1. Payment model

  1. Points are purchased as a one-time purchase (no subscription) in one of the available Points Packages.
  2. Current Points Package offers:

    Users purchasing in USD via Stripe pay the following tiers instead: $7 for 50 Points, $15 for 250 Points, and $29 for 1000 Points.

  3. Points are credited to the User's Account immediately after payment is confirmed and do not expire.
  4. Points may not be exchanged for cash or transferred to another Account.

4.2. Payment terms

  1. PLN payments are processed through the Paynow system (mBank S.A.) using the available payment methods (BLIK, payment card, bank transfer). USD payments are processed through Stripe.
  2. Prices shown in the Service are gross prices (VAT included, where applicable).
  3. For PLN purchases, the Service Provider issues a Polish VAT invoice on the User's request. To request an invoice, contact: kontakt@promptgenerator.pl with your invoice details. For USD purchases made via Stripe, the User instead receives an automated Stripe payment receipt by email in place of a Polish VAT invoice.

4.3. Price changes

  1. The Service Provider reserves the right to change the pricing of Points Packages. A price change does not affect Points already purchased by a User.
  2. Current prices are always visible on the Points purchase page in the Service.

4.4. Point refund on a failed generation

If an image generation fails due to an error on the Service's side, the spent Point is automatically refunded to the User's Account.

§4a. Digital Products (e-books)

  1. The Service allows a one-time purchase of Digital Products (e.g. e-books and prompt packs in PDF format). Current offers, gross prices, and content descriptions are always visible on the relevant Digital Product page.
  2. Purchasing a Digital Product does not require an Account. Completing the order requires an email address (for delivery), full name, and billing address details.
  3. The Digital Product is delivered immediately after payment is confirmed: a download link is made available on the purchase confirmation page and sent to the provided email address, along with a receipt or invoice as applicable.
  4. By purchasing a Digital Product, a User who is a Consumer or a sole trader with consumer rights consents to immediate delivery of the digital content before the 14-day withdrawal period expires, and acknowledges that the statutory right of withdrawal is lost once delivery has taken place (Art. 38(13) of the Polish Consumer Rights Act).
  5. Regardless of the above, the Service Provider grants a contractual satisfaction guarantee on Digital Products: within 30 days of purchase, the User may withdraw from the agreement without giving a reason, by sending a message to kontakt@promptgenerator.pl or replying to the purchase email. A full refund of the amount paid is issued promptly, no later than within 14 days, using the same payment method.
  6. Digital Products are protected by copyright. Purchase grants a license for personal use (including within the User's own business activity); further resale, public distribution, or redistribution requires the Service Provider's consent.

§5. Terms of use of the Service

  1. Using the Service requires a device with internet access and an up-to-date web browser.
  2. Some features of the Service are available without registration. Full access to the services (including the AI Image Studio and purchasing Points) requires creating an Account.
  3. Registration with the Service is voluntary and free. The User agrees to provide accurate information during registration.

§6. Rights and obligations of the User

The User agrees to:

  • Use the Service in accordance with applicable law and these Terms.
  • Refrain from actions that could disrupt the operation of the Service.
  • Refrain from creating prompts or images that contain unlawful, offensive, or discriminatory content, or content that infringes the rights of third parties.
  • Refrain from attempting to gain unauthorized access to the Service's resources.
  • Refrain from sharing Account login credentials with third parties.

§7. Intellectual property

All materials published in the Service, including text, graphics, logos, page layout, and software, are the property of the Service Provider or are used under applicable licenses and are protected by law.

Prompts generated by the User using the Service's tools may be used freely by the User. The Service Provider claims no rights to the content of prompts created by Users.

Images generated by the User in the AI Image Studio may be used freely by the User, subject to any restrictions arising from the terms of use of the AI models used to generate them.

§8. Right of withdrawal (Consumers and sole traders with consumer rights)

8.1. Right of withdrawal

  1. A User who is a Consumer or a sole trader with consumer rights has the right to withdraw from a distance contract within 14 days of the date the contract was concluded (i.e. from the date of purchase of a Points Package), without giving a reason.
  2. To exercise the right of withdrawal, the User must inform the Service Provider of their decision through an unambiguous statement sent to: kontakt@promptgenerator.pl or in writing to the Service Provider's registered address.
  3. To meet the deadline, it is enough to send the statement before it expires.

8.2. Consent to begin performance before the withdrawal period expires

  1. By purchasing a Points Package, a User who is a Consumer or a sole trader with consumer rights consents to the immediate availability of Points on their Account before the 14-day withdrawal period expires.
  2. The User acknowledges that once a Point has been used (an image has been generated), the right of withdrawal is lost with respect to that used Point (Art. 38(1) of the Polish Consumer Rights Act).

8.3. Loss of the right of withdrawal

The User loses the right to withdraw from the agreement with respect to Points that were used (i.e. used to generate images) before submitting a withdrawal statement.

8.4. Effects of withdrawal

  1. If withdrawal is effective, the Service Provider will refund the User a payment proportional to the number of unused Points, promptly and no later than within 14 days of receiving the withdrawal statement.
  2. The refund is issued using the same payment method the User used, unless the User has expressly agreed to a different refund method.
  3. Unused Points covered by the withdrawal are removed from the User's Account.

§9. Liability

  1. The Service Provider makes every effort to ensure the Service operates correctly and without interruption, but does not guarantee uninterrupted availability of the Service.
  2. The Service Provider is not liable for:
    • The consequences of the User's use of generated prompts or images.
    • The quality or accuracy of responses obtained from AI models using generated prompts.
    • Content generated by external AI models based on prompts.
    • Service interruptions caused by reasons beyond the Service Provider's control.
    • Actions by Users that violate the Terms or applicable law.
  3. The Service Provider strives to make images generated in the AI Image Studio as high-quality as possible; however, due to the nature of AI technology, it does not guarantee that the result will fully match the User's expectations.

§10. Personal data protection

The rules for processing Users' personal data are set out in the Privacy Policy, which forms an integral part of these Terms.

§11. Complaints

  1. Complaints about the operation of the Service, including purchased Points, may be submitted electronically to: kontakt@promptgenerator.pl
  2. A complaint should include a description of the issue and the User's contact details. The Service Provider will review the complaint within 14 days of receiving it.
  3. If a complaint regarding Points is upheld, the Service Provider will, at the User's choice, either return the Points to the User's Account or issue a monetary refund.

§12. Account deletion

  1. The User may stop using the Service and delete their Account at any time by contacting the Service Provider at kontakt@promptgenerator.pl.
  2. Deleting an Account results in the permanent loss of unused Points, which the User will be informed of before the deletion is confirmed.
  3. The Service Provider reserves the right to block or delete the Account of a User who violates these Terms.

§13. Changes to the Terms

  1. The Service Provider reserves the right to amend these Terms. Users will be informed of any changes by publication of the updated Terms on the Service website.
  2. Continued use of the Service after changes take effect constitutes acceptance of those changes.
  3. A change to the Terms does not affect Points purchased before it takes effect - such Points continue to be used under the rules in force at the time of purchase.

§14. Final provisions

  1. Matters not covered by these Terms are governed by Polish law, in particular the Polish Civil Code, the Act on the Provision of Electronic Services, and the Act on Consumer Rights.
  2. Any disputes arising from use of the Service will be resolved by the court with jurisdiction over the Service Provider's registered address, except that disputes with Consumers are resolved by the court with jurisdiction under the Polish Code of Civil Procedure.
  3. Consumers may use out-of-court methods for handling complaints and pursuing claims, including via the EU ODR platform, available at: https://ec.europa.eu/consumers/odr
